The accident happened while she was trying to take the bike out of the shed.
The compensation of more than 1 million Danish crowns comes seven years after she suffered a serious injury in 2016 when she hit her head on a concrete lintel in a bicycle shed at her workplace. writes folkeskolen.dk.
The injury resulted in a concussion and a loss of work capacity of 55 percent was established. After the accident, the member was on sick leave and was subsequently terminated from his employment at a municipal workplace.
Only now has a Danish court determined that the damage was attributable to the employer.
– First of all, we are very happy that the member is now receiving significantly more compensation than initially indicated. And this is also an important principled judgment for us, says Thomas Andreasen, chairman of the working environment committee of the Danish Teachers’ Association (DLF).
Andreasen says this as an important judgment:
– It is absolutely essential that our members can go to work without fear of being exposed to physical injury. This judgment highlights the responsibility of municipalities and other employers to ensure that workplaces are designed so that employees avoid accidents like this, which have had serious negative consequences for our member.
In 2021, the DLF helped its members obtain financial compensation of more than NOK 100 million in work accident cases.
